TERMS & CONDITIONS
1. Before Hiring
• The hirer must complete the hirer agreement form before taking possession of any equipment or starting any hire
• For groups each member of the group should fill in the agreement form ensuring that each member of the party is fully aware of the risks involved
• Members under the age of 18 must be signed on behalf off by a parent or guardian
• All members must be individually named on the agreement and each must affirm:
• Their acceptance of the ‘Hire Agreement’ and ‘Hirer’s Obligations’
• That they’ve disclosed any medical conditions
• That hazards and rules have been read by a member of staff and that these are understood
2. General
• The company is ‘Hopwood Adventure’ and the ‘Hirer’ is any member or company who hires or has agreed to hire equipment, which are items provided by the company. This is set out in the hire agreement
3. Acceptance of Terms and Conditions
• Bookings made by telephone or online will have provided a copy of these terms and conditions which will need to be accepted
4. Hirers’ Obligations
• Anyone under the age of 18 must be accompanied by an adult
• Children aged 7-14 must have an adult in the kayak with them
• Children aged 14-17 to be accompanied by one adult
• The youngest age for a passenger is 5 on the Hopwood Canal
• Children aged 12-17 to be accompanied by one adult
• All members participate subject to wearing a correctly fitted buoyancy aid
• Maximum weight is 18st
• Buoyancy aids go up to size XXL.
5. The Hirer Agrees To:
• Keep equipment in their possession and under control and only use this for the purposes of the trip
• Allow a company representative access to the equipment at all reasonable times for inspection, repair and removal of equipment
• Be responsible for any losses or damage caused by themselves as they will be charged at the end of the hire period after inspection
• Not sell, sublet or dispose of any equipment and will indemnify the company against all losses, costs, claims, damage and expenses howsoever occasioned by their breach of these conditions
• Consumption of alcohol in the boats is prohibited and will lead to termination and potential charges if breached
6. Maintenance
• The company confirms that all hired equipment will be in full working condition, provided that the hirer has abided by all obligations outlined
7. Loss or Damage
• The hirer assumes complete responsibility for loss or damage of equipment (other than wear and tear) once in their possession
8. Breach
• Any breach of this agreement on the hirer’s behalf may result in termination without a refund and if equipment is still in possession then authorities may be contacted
9. Bookings
• Costs of hiring and tours must be paid in full before the start of agreed hire. A booking is valid once full payment has been received
10. Travel
• The hirer is responsible for travel arrangements
11. Cancellations
• Hire is subject to safe weather conditions
• If postponing is deemed necessary, we will try to provide enough notice and offer an alternative time period
• If an alternative date is not possible, a full refund will be provided
• The company are not liable for any losses
• A 50% charge will be taken if a cancellation is made within 14 days of the start date
• Full charge will be taken if a cancellation is made within 48 hours of the start date
• Cancellations made outside of the 14 day period will be refunded in full, deducting a £10 administration fee
12. Disclaimer
• The company isn’t liable for any deaths, personal injury or loss or damage to personal goods
• Any water resistant containers provided by us are not guaranteed to be entirely waterproof so these should not be relied on
• Taking any personal belongings onto the canal is at your own risk
13. Changes
• We reserve the right to make amendments to the terms and conditions without notice. The full and latest version are available on our website
